1. Licensing & Usage Rights
All photographs captured and shared by Wesley Sherow (@wesleysherow) are protected by U.S. copyright law and remain the sole intellectual property of Wesley Sherow at all times, unless otherwise stated in a written agreement. By accessing, downloading, or sharing any images, you agree to the following terms:
1.1 Permitted Uses (Personal Use License)
You are welcome to:
Share watermarked images on social media platforms with visible watermark intact and proper credit to @wesleysherow in the caption or tag.
Use photographs for personal enjoyment, such as digital wallpapers, personal prints, or sharing privately with friends and family.
1.2 Prohibited Uses (Without Separate Written License)
You may not:
Use photographs for any commercial purpose, including but not limited to: advertisements, marketing materials, product listings, paid promotions, merchandise, or resale in any form.
Remove or alter watermarks on free/shared images.
Edit or modify images beyond basic cropping and resizing for display, without prior written consent.
Use images in any context that is unlawful, defamatory, or otherwise harmful to the reputation of @wesleysherow or any subjects depicted.
1.3 Purchased Images
When you purchase a photograph:
You receive a high-resolution, watermark-free digital copy for personal use only.
Commercial use rights are not included and require a separate commercial licensing agreement.
1.4 Enforcement
Any unauthorized use of images beyond these terms may result in legal action and/or an invoice at current commercial licensing rates plus recovery of legal fees.
2. Payment, Refund, and Delivery Terms
2.1 Payment
All prices are listed in U.S. Dollars (USD) and are subject to change without notice.
Payment is due in full at the time of purchase unless otherwise agreed in writing.
Accepted payment methods include Credit/Debit Card, Paypal, Bank Transfer
2.2 Refunds
Digital purchases are non-refundable once the download link or file has been delivered, due to the irreversible nature of digital goods.
For physical products (if applicable), refund or replacement is only available in the case of a manufacturing defect or damage in transit, and must be requested within 7 days of delivery.
2.3 Delivery of Digital Images
Digital files are delivered via email, private link, or online gallery within the timeframe specified at purchase.
Wesley Sherow is not responsible for delays caused by technical issues beyond reasonable control, including server downtime or email filtering.
Download links are active for a limited time; it is your responsibility to save and back up purchased images promptly.
2.4 Free Event Galleries
Free event coverage is provided at Wesley Sherow’s sole discretion and with no guarantee of delivery time, number of images, or availability of specific shots.
Free galleries may be removed after 30 days without notice.
3. Event Coverage Disclaimers
3.1 No Guarantee of Specific Shots
While every effort is made to capture high-quality images, Wesley Sherow does not guarantee the inclusion of any specific person, moment, or scene. The nature of live events means certain shots may be missed due to lighting conditions, crowding, restrictions, or other circumstances outside reasonable control.
3.2 Artistic Discretion
All photographs are taken and edited at the sole artistic discretion of Wesley Sherow. Selection of final images for delivery is at the photographer’s judgment; unedited or raw image files are not provided under any circumstances.
3.3 Free and Unpaid Event Coverage
When coverage is provided at no charge, it is done so at Wesley Sherow’s sole discretion, with no guaranteed number of photographs, delivery schedule, or continued access to galleries. Free event galleries may be removed at any time after 30 days without notice.
3.4 Technical & Venue Limitations
Wesley Sherow is not responsible for missed shots or reduced image quality due to factors outside control, including but not limited to:
Low or changing lighting
Venue-imposed photography restrictions
Interference by guests or event staff
Weather conditions
4. Model Releases & Privacy
4.1 Consent to Photography
Attendance at any public or ticketed event where Wesley Sherow is photographing constitutes implied consent to be photographed. This includes candid, posed, and group images.
4.2 Use of Images
Unless otherwise agreed in writing, Wesley Sherow may use any photographs taken at an event for portfolio display, website content, social media, marketing materials, and other promotional purposes.
4.3 Privacy Requests & Opt-Out
If you appear in a photograph and wish to have it removed from public display, you may submit a written request to w@wesleysherow.com including:
A link or clear description of the image in question
Proof of your identity as the subject
Upon verification, Wesley Sherow will make reasonable efforts to remove the image from public-facing platforms. This does not apply to lawful uses in print media or cases where removal is not technically feasible.
4.4 No Compensation
Unless specifically contracted and paid as a model, appearing in a photograph does not entitle you to compensation, royalties, or ownership of the image.
5. Limitation of Liability
5.1 No Liability for Event Outcomes
Wesley Sherow shall not be held liable for any loss, damage, or dissatisfaction arising from the use or non-use of photographs, including missed shots, perceived lack of coverage, or artistic choices.
5.2 No Liability for Third-Party Actions
Wesley Sherow is not responsible for how third parties (such as event organizers, guests, or venues) use, alter, or distribute photographs once shared or published in a public or semi-public setting.
5.3 No Liability for Indirect Damages
Under no circumstances shall Wesley Sherow be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to emotional distress, loss of opportunity, or reputational harm resulting from the creation, distribution, or publication of photographs.
5.4 Force Majeure
Wesley Sherow is not responsible for failure or delay in performance due to events beyond reasonable control, including but not limited to acts of God, natural disasters, technical failures, illness, or transportation delays.
6. Copyright Enforcement
6.1 Ownership of Copyright
All photographs, whether watermarked, purchased, or otherwise obtained, are protected by U.S. and international copyright law and remain the sole property of Wesley Sherow.
6.2 Unauthorized Use
Any use of photographs beyond the scope of the license granted (see Section 1) without prior written permission constitutes copyright infringement. This includes but is not limited to:
Commercial use without a commercial license
Removal or alteration of watermarks
Sale, distribution, or reproduction without authorization
6.3 Remedies
Unauthorized commercial use will result in an invoice at Wesley Sherow’s current commercial licensing rates, plus any applicable legal fees, damages, and costs associated with enforcement.
6.4 Reporting Infringement
If you believe someone is using Wesley Sherow’s photographs without authorization, please contact [your email address] with details so that appropriate action can be taken.
7. General Website Terms
7.1 Modifications to Terms
Wesley Sherow reserves the right to update or modify these Terms of Service at any time without prior notice. Continued use of this website or its images constitutes acceptance of the current Terms.
7.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, United States. Any disputes shall be resolved exclusively in the courts located in New York County, New York.
